The LMIA program is run by ESDC (Employment & Social Development Canada) which is NOT part of IRCC and is not directly involved with immigration or work permits. The requirements are as follows:

1. You must own at least 50.1% share of the Canadian business.

2. Your average salary at your old job must be equal or above the top 10% of wages earned by Canadian citizens or permanent residents in the province/territory where the owner will be working.

3. You must employ one or more Canadian employees (this includes permanent residents) in your company within the first year.


The owner must also be involved in the day-to-day operation of the business and have an employment relationship with it. This stream is therefore not meant for silent partners or passive investors. This can be demonstrated by taking the necessary steps to commence the business. This could include a strong and well though-out business plan, opening a bank account, incorporating and getting the required documentation from the Canada Revenue Agency as well as any required license and/or registration documentation from the government, hiring staff and signing a lease agreement.


WHAT IS THE PROCESS?

1. Outlines a business plan or identify a Canadian business to purchase.

2. Submit a Labor Market Impact Assessment (LMIA) along with a suitable business plan.

3. Once a positive LMIA opinion is issued, the foreign national applies for a 12-24 months, renewable temporary work permit at the management level.

Keeping Yourself Ready For Canadian Immigration


WHAT TO ASK (AND NOT TO ASK) WHEN IMMIGRATING TO CANADA

Let’s say you, yes you! intend to immigrate to Canada. Of course, you are willing to find a fast and easy way for immigration. However, what if we told you to avoid asking specific questions when you intend to immigrate to Canada? You would probably wonder why is that? Isn’t it a legitimate question to expect a fast, easy, cheap and guaranteed immigration option?

AVOID ASKING THESE QUESTIONS!

1. Don’t ask: “Can you offer me an easy immigration option?”

The process of immigration to Canada is challenging. Why? Simply put, millions of people want to immigrate to Canada. However, Canada can accept a limited number of immigrants every year. Therefore, they put many measures to cherry-pick the best candidates. For example, some of the typical requirements include the following:

IRCC aimed to process 80 per cent of all Express Entry immigration applications in six months or less. Notably, the time it takes for IRCC to process a permanent residence application is only one part of the Express Entry process. So, you should anticipate that the entire process will be longer than the average processing time listed above for the permanent residence application.

3. Don’t ask: “Can you offer me a cheap immigration option?”

4. Don’t ask: “Can you guarantee my success?”

What a weird question that we hear a few times a month! Let me frankly with you. No one in this the world can guarantee your success. Here are some reasons:

The decision-maker is an immigration officer, not the immigration practitioner: How can you expect the middle-man to guarantee the decisions of the authorities in charge?

Whether we like it or not, the immigration officers can incorporate their discretion in the decision-making process. Of course, they have to follow the immigration law, but the law leaves room for them to decide. Even courts rarely interfere with the job of an immigration officer.

QUESTIONS YOU MUST ASK!

There are so many unauthorized agents/immigration consultants, however almost 99% in India aren’t legally authorized to provide immigration services and hence it’s very important for customers to do their thorough study and not fall for heavy marketing.

However, you can’t get pre-arrival services if you’re coming to Canada for a short time. That is, you’re a temporary resident visiting, studying or working in Canada on a visa or permit.

connect with employers to find a job
connect with free services after you arrive in Canada

2. Giving you discounts that are too good to be true? Perhaps they are!

99% of XYZ agencies claim affiliation to RCIC and hence if you choose to get direct consultation or authorized representation on your file they will explain to you that it will be more expensive and hence not preferred by them. These agencies find it cheaper to give you consultation through their untrained staff who have as much the knowledge you have about the system that you can reasonably gather online. To have an ICCRC Regulated consultant giving you one on one consultation, these immigration consultant firms will have to spend way higher than the cheap fees they offer their services at.

Express Entry Draw and PNP News-Round up May 2020


The Express Entry the system has selected applicants who have experience working in Canada and those with the most in-demand skills required by individual provinces. In the first two major draws at the beginning of the month:
1.     May 1, 2020 - Express Entry draw #146 - 3,311 applicants from the Canadian Experience Class (CEC) were invited to apply for permanent residency in Canada. The CRS cut-off for this draw was 452 points.
2.     May 13, 2020 - Express Entry draw #147 - 529 applicants with a Provincial Nomination and a CRS of 718 points were invited to apply for permanent residency.
To obtain a provincial nomination, you can create an Expression of Interest (EOI) in a particular province or territory on your Express Entry profile. If your skills or qualifications are in demand by that province, they will issue you a provincial nomination, contributing 600 points to your CRS score. In other words, a provincial nomination all but guarantees an invitation to apply for permanent residency in Canada.

The next two major draws took place halfway through the month, and another 3,900 applicants were issued ITA’s:
1.     May 14, 2020 - Express Entry draw #147- 3,371 applicants from the Canadian Experience Class (CEC) were invited to apply for permanent residency in Canada. The CRS cut-off for this draw was 447 points.
2.     May 27, 2020 - Express Entry draw #148 – 385 applicants with a Provincial Nomination and a CRS of 757 points were invited to apply for permanent residency.
3.     May 28, 2020 - Express Entry draw #149- 3,515 applicants from the Canadian Experience Class (CEC) were invited to apply for permanent residency in Canada. The CRS cut-off for this draw was 440 points.
MAY PROVINCIAL NOMINEE DRAW ROUNDUP 2020
Let’s take a closer look at the applications provinces chose to nominate, to get a better idea of where your future may lie:
1.     Saskatchewan - invited 252 applicants with work experience in 44 different in-demand occupations. The occupations in-demand is a subcategory for applicants who do not have an Express Entry profile, so these are people invited outside of the Express Entrysystem. 2.     Alberta - invited 191 applicants with a CRS score as low as 300 from the Express Entry system. These applicants are all working in Alberta at present under a valid work permit.
3.     British Columbia - invited 225 applicants through its Tech Pilot draw. International workers and graduates from 29 in-demand technology occupations received ITA’s as the province continues to grow its tech sector.
4.     Nova Scotia - invited an undisclosed number of registered nurses to apply for permanent residency and make the beautiful Atlantic province their new home.
5.     Manitoba - issued 99 ITA’s to applicants from three different provincial programs:
Skilled workers in Manitoba - 72 ITA’s
Skilled Workers overseas - 15 ITA’s
International Education Stream - 12 ITA’s
6.     Prince Edward Island - only 29 candidates were invited to apply as the island province takes a more cautious approach to re-opening their economy after the pandemic. All of these ITA’s were issued through the Express Entry system.

COVID-19: Changes to Canadian Immigration Procedures

Although most of the decisions are on standby and a certain delay, there haven’t been many major changes to the Canadian Immigration Procedures. There has been a slight change which has been more on a considerate basis. There aren’t going to be any rejections as such while applying for a PR rather a slight delay may be there.


While Canada has imposed travel restrictions, candidates are still welcome to submit Express Entry profiles as well as their permanent and temporary residence applications. Canada continues to hold Express Entry draws and issue invitations to apply for permanent residence. Canada is also being more flexible in processing applications by providing candidates with more time to obtain and submit their documentation in case candidates are being affected by COVID-19 disruptions.

The following are the only entrants allowed in Canada at the moment:
  • Canadian citizens
  • Permanent residents
  • Immediate family of Canadian citizens and permanent residents (spouses, common-law partners, dependent children, grandchildren, parent or step-parent, and guardian or tutor)
  • Permanent resident applicants who were approved for permanent residence before Canada announced its travel restrictions on March 16, 2020, but who had not yet travelled to Canada
  • Temporary foreign workers
  • International students who held a valid study permit or who had been approved for a study permit when Canada’s travel restrictions took effect on March 18, 2020

Express Entry draws continue and federal and provincial governments continue to issue invitations to apply for permanent residence

starting March 16th, all in-person landing appointments are cancelled and will be held by telephone. IRCC will contact you by email to let you know when your new telephone appointment will be.

Biometrics deadline extended to 90 days, rather than 30. There will be 90-day extensions for additional document requests on open applications.

It is mandatory for those entering Canada to self-isolate for 14 days.

The travel restrictions are in place until June 30, 2020, at noon EDT.

The measures do not apply to trade or business

What is the best provincial nominee program for immigrating in 2020


I wouldn’t really worry about which is the best program at the moment as due to Canada’s new targets and high goals that have been set, they are looking forward to inviting several individuals to the country by the end of 2022. Due to this whole new Goal, several provinces have opened up their programs to invite various individuals across the globe as at the same time there are plenty of job opportunities in all the fields that are in demand right now. But however, a list of the few provincial programs below will give you an insight into the various NOCS in demand and opportunities that are arising.




#1 – Saskatchewan’s International Skilled Worker 

This program is designed to bring workers with experience in the province’s in-demand occupations. In order to be eligible, a candidate must have at least one year of experience in one of the jobs included on Saskatchewan’s in-demand occupation list. Also, candidates must have completed a post-secondary educational credential of at least one year and have some proficiency in either English or French. 
There are two streams of Saskatchewan International Skilled Worker that is for Candidates outside Canada. First, the SINP stream, which requires an Express Entry profile in order to apply. Second, the Saskatchewan Occupations In-Demand stream, who doesn’t require an Express Entry profile but rather focuses on the occupation.

#2- Ontario’s Human Capital Priorities Stream

Capital Priorities is aligned with the Federal Express Entry system. In order to be considered, a candidate must have an express entry profile with a CRS score of 400 points or higher. Ontario scans through all the express entry profiles and invites certain profiles to apply to the PNP. 

Last summer, Ontario had begun conducting draws targeted to tech workers under the Human Capital Priorities Stream. To be eligible, applicants are required to have work experience in one of six designated NOC codes mentioned above. Since its launch, the province has issued a total of 4350 invitations. 

#3- Alberta’s Express Entry Stream

The Alberta Express Entry stream selects candidates from the federal Express Entry pool and invites them to apply for a nomination by the province. One of the major benefits of this stream is that the minimum CRS score is 300. Receiving a provincial nomination will credit 600 points in the candidate’s profile virtually guaranteeing ITA in the next Express Entry draw.
